The following statement on the Texas Senate State Affairs Committee’s recent passage of House Bill 1463 should be attributed to Jennifer Harris, Executive Director of Texans Against Lawsuit Abuse (TALA):

“Texans Against Lawsuit Abuse is pleased to see House Bill 1463 move one step closer to the governor’s desk, and we hope the full Senate moves swiftly to approve this important legislation that preserves the true intent of the Americans with Disabilities Act and defends against abusive lawsuits.

“HB 1463 would require property owners to be notified of potential ADA violations and be given a right to correct any issue – before a lawsuit is filed. HB 1463 is smart, common-sense reform. HB 1463 will help improve access by putting the focus on compliance, not lawsuits.

“It’s time to put a stop to drive-by lawsuits that are filed under the guise of the federal American with Disabilities Act (ADA) and are exploiting a well-intentioned and important law. Such lawsuits aren’t about fixing a problem and improving access, they’re about enriching personal injury lawyers.”
