The following statement on the Texas House’s recent passage of House Bill 1463 should be attributed to Jennifer Harris, Executive Director of Texans Against Lawsuit Abuse (TALA):

“Drive-by lawsuits filed under the guise of the federal American with Disabilities Act (ADA) are exploiting a well-intentioned and important law. Such lawsuits aren’t about fixing a problem and improving access, they’re about enriching personal injury lawyers.

“By requiring property owners be notified of potential ADA violations and be given a right to correct any issue – before a lawsuit is filed, House Bill 1463 is smart, common-sense reform. HB 1463 will help improve access by putting the focus on compliance, not lawsuits.

“We laud the Texas House’s approval of House Bill 1463, which would protect small business owners from abusive ADA lawsuits, while protecting the well-meaning ADA. We ask the Senate to move this important reform forward, bringing it to the governor’s desk.”
