Some personal injury lawyers exploit the American Disabilities Act (ADA) to shake down small businesses for cash settlements to avoid high cost court cases. House Bill 1463 and Senate Bill 827 propose that property owners be notified of potential violations and be given a right to cure, while ensuring people with disabilities continue to be protected. The bills also propose to entrust the Attorney General with enforcement authority over bad faith ADA claims. Thus, protecting small business owners and protecting the well-meaning ADA law.
